End User License Agreement (EULA)

Effective Date: 12/30/2024

This End User License Agreement ("Agreement") is between Berat Deniz Elgay ("Developer," "we," "us," or "our") and you ("End-User" or "you") and governs your use of the Florida Real Estate News mobile application ("Licensed Application").

1. Acknowledgment
This Agreement is between you and the Developer only, not Apple. The Developer, not Apple, is solely responsible for the Licensed Application and its content. Your use of the Licensed Application must comply with Apple Media Services Terms and Conditions, which you acknowledge having reviewed.

2. Scope of License
The license granted to you is a limited, non-exclusive, non-transferable license to use the Licensed Application on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple Media Services Terms and Conditions. Family Sharing and volume purchasing are permitted per Apple's terms.

3. Maintenance and Support
The Developer is solely responsible for providing maintenance and support for the Licensed Application. Apple has no obligation to provide maintenance or support. For support inquiries, you may contact us at:

4. Warranty
The Licensed Application is provided "as is." The Developer is solely responsible for any product warranties, express or implied, unless disclaimed. In case of a failure to meet any applicable warranty, you may notify Apple for a refund of your purchase price (if applicable). To the maximum extent permitted by law, Apple has no further warranty obligation regarding the Licensed Application, and any additional claims or liabilities will be handled by the Developer.

5. Product Claims
The Developer is responsible for addressing any claims by you or third parties related to the Licensed Application, including but not limited to:
(i) product liability claims,
(ii) failure to conform to legal or regulatory requirements, and
(iii) claims under consumer protection, privacy, or similar laws.

6. Intellectual Property Rights
In the event of a third-party claim that the Licensed Application infringes intellectual property rights, the Developer will be solely responsible for the investigation, defense, settlement, and discharge of the claim.

7. Legal Compliance
By using the Licensed Application, you represent and warrant that:
(i) You are not located in a country subject to a U.S. Government embargo or designated as a “terrorist-supporting” country, and
(ii) You are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-Party Terms of Agreement
You must comply with applicable third-party terms when using the Licensed Application, including any agreements related to your internet or wireless data services.

10. Third-Party Beneficiary
You and the Developer acknowledge that Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of the terms and conditions, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.

11. In-App Purchases
The Licensed Application is free to download and use. It offers optional subscriptions to remove in-app advertisements. Subscription terms are available within the app.

12. Termination
This Agreement is effective until terminated by you or the Developer. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms.

13. Governing Law
This Agreement is governed by the laws of [Insert Jurisdiction] without regard to its conflict of law principles.

14. Entire Agreement
This Agreement constitutes the entire agreement between you and the Developer regarding the Licensed Application and supersedes any prior or contemporaneous understandings.
